In Texas, possession of marijuana is defined as “knowingly or intentionally possessing a usable amount of marijuana.” Sec. 481.121.   If the amount is 2 oz. or less it is a Class B misdemeanor and if the amount is over 2 oz., but less than 4 oz., then it is a Class A misdemeanor.

Generally, as long as a person is charged with Class A or Class B misdemeanor possession of marijuana, he or she is eligible to be released with an Attorney Writ Bond.  The preset bond amount for a possession charge in Collin County is 350.00 for a Class B, charge and 500.00 for a Class A charge.  If you post a “cash” bond with the jail at the time of the defendant’s release, then this amount is refunded at the end of the case.
