In Texas, Driving While Intoxicated is defined as being “intoxicated while operating a motor vehicle in a public place.”

The State defines  “Intoxicated” as:

“(A) not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or

(B) having an alcohol concentration of 0.08 or more.” Sec. 49.04.

Generally, as long as a person is charged with a Class A or Class B misdemeanor DWI, he or she is eligible to be released with an Attorney Writ Bond.  The preset bond amount for a DWI (Class A or Class B) in Collin County is 500.00.  If you post a “cash” bond with the jail at the time of release, then the 500.00 is refunded at the end of the case.

THE BOND HEARING

When someone is released with an Attorney Writ Bond for DWI in Collin County, they must be present at a “Bond Hearing” on the “Monday next after the passing of 7 days.”  For example, if the arrested person is released on a Friday, then he must appear at the Bond Hearing on the Monday after next.  This Bond Hearing is where the Judge determines the conditions of bond.  The reason for this is because with an Attorney Writ Bond, the arrested person was released without seeing a judge, so the judge was not able to set any conditions as part of the release on bond.  These conditions could include:  No alcohol, or the installation of a deep lung device (ignition interlock) in any vehicle driven by the person arrested.  There may be no conditions.  The terms vary for various reasons and we will let you know exactly what to expect.

We will give you the exact date when your loved one must appear for the Bond Hearing, and we will appear there with him  at no additional charge.   This service is included in our fee for the Writ Bond.
